A． Costs Estimate For Trade Marks Application in Philippines (for simple straightforward application)
菲律賓商標注冊申請費用（以一個簡單的申請計算）

1.SEARCH 查詢（Optional 非必須的）USD美金

a) Availability search-comprehensive report 綜合的查詢及報告
(selective, not compulsory 選擇性，非必須) $350
（including instruction our associate/agent to conduct the search of the Trade
Marks Register, reviewing and reporting the search results with advice on registration）
申請前查詢的作用是找出類似或相同并對申請有影響的已申請/注冊的商標。
此費用包括在商標注冊署進行商標查詢﹑分析和報告查詢結(jié)果以及提供建議。

*Search will be charge per logo per class* 查詢費用以每個圖形及類別計算

2.FILING OF APPLICATION (for one trademark one class) 申請費用 $850
(以一個商標一個類別計算)

The fees includes professional service fees of classifying the goods or services, preparing the relevant application form , filing the application and reporting filing particulars.
此費用包括商標分類服務、準備有關(guān)申請表格及文件、提出申請及報告申請進度。

b) FILING OF “REQUEST FOR EXTENSION OF DECLARATION” $150
要求聲明延期
FILING OF “DECLARATION OF USE” (“DAU”)
使用的聲明 $500
The fee is relevant when the trademark has not been used in the Philippines.
If the mark is used commercially in the Philippines, it is not necessary to file the DAU.

c) ACCEPTANCE OF REGISTRATION (for one trademark one class) $450
注冊費用（以一個商標一個類別計算）

The fees includes professional service fees of reporting the allowance of publication, preparing for the publication of Government Gazette, paying official fees, reporting acceptance of registration, obtaining and forwarding the Certificate of Registration.
Validity: TEN(10) years.
此費用包括報告公告的許可通知﹑辦理公告事宜﹑報告獲準注冊通知﹑領(lǐng)取及寄上注冊證書以及繳付官方費用。
Validity: TEN (10)years 有效期為十年.

3.MISC(Additional Service Charges 額外服務)

a) Drafting, Amending and Filing Arguments草擬、修改及申辯費用
( simple argument per case以每個簡單的申辯 計算 ) $400 -$1，300

The argument fees may be adjusted based on the complexity of the cases, separate quotation will be issued for cases involving court proceeding.
此費用只限于一般申辯及會因為案件的復雜程度而有所調(diào)整。另涉及法院程序的案件會根據(jù)個別律師的費用而定，我方將會預先通知。

b) Renewal（for 10 years）續(xù)期( 有效期為十年）
i) For one mark one class 以一個商標申請一個類別計算

C) Change of Address/Name of Applicant 更換申請人名稱或地址

(including government fees) 此費用包括繳付官方費用 $150

B． Procedure for applying trade mark registration 商標注冊申請的程序
Ⅰ.A word, logo or both, which is distinctive, can be applied for trademark registration.
任何具顯著性的文字﹑圖案或文字加圖案的標記均可申請注冊。

Ⅱ. An availability search is usually recommended to find out whether there is any similar or identical filed/registered marks which may bar your application. After the search, the filing of the mark will be applied in the specified class with up to 10 designed goods or services. There are totally 45 classes. The fees for trademark application is for 10 years and the trademark could be renewed every 10 years.
申請前查詢的作用是找出類似或相同并對申請有影響的已申請/注冊的商標。查詢后再分類為最多十項指定物品或服務，總共有45類。費用為有效期十年。之后可在到期日或之前，續(xù)期十年。

Ⅲ. After the filing of the application, the Registry will examine the mark in the application. If the application fulfills the requirement, then the application will be granted by the examiner and the Registry will require the applicant to advertise the trademark. If no opposition to the application is filed in 1-3 months time, the Registry will grant the application and issue the certificate. The time span from filing to obtaining a trademark will normally take approximately 12-18 months.
提交申請后，商標注冊署審查員會對申請作出審查。如申請合乎商標法條例及沒有抵觸其他注冊或已申請注冊的商標，注冊署會發(fā)出公告許可證及列明商標獲準注冊所須遵辦的條件。如在公告日期起計之1-3個月內(nèi)沒有人提出反對，申請人將于12至18個月后便可申領(lǐng)注冊證書。
